These Terms & Conditions (“Terms”) govern your access to and use of defiancelaser.com (the “Site”) and any purchase you make from Defiance Laser (“Defiance Laser,” “we,” “us,” or “our”). Please read them carefully. By accessing the Site, placing an order, or otherwise using our services, you agree to be bound by these Terms.

1. EligibilityYou must be at least 18 years old, or have the consent and supervision of a parent or legal guardian, to use the Site or place an order. By placing an order, you represent that you meet these requirements and that the information you provide is accurate and complete.
2. AccountsYou may be able to create an account to manage orders. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Please notify us promptly of any unauthorized use.
3. Products and Custom OrdersWe specialize in custom and personalized laser-engraved products. Because most items are made to order based on your specifications, please review all details carefully before submitting your order. Once production begins, custom orders generally cannot be changed or canceled.

   We use digital proofs for many orders, and proofs are strongly recommended for complex or bulk orders. Where a proof is provided, it is your responsibility to review it carefully and confirm that spelling, layout, artwork, dates, names, and all other details are correct before approving production.

4. Artwork and Your ContentWhen you upload or send artwork, text, logos, or other content for engraving (“Your Content”), you represent and warrant that:
   • You own Your Content or have all necessary rights, licenses, and permissions to use it and to authorize us to reproduce and engrave it.
   • Your Content does not infringe the intellectual property, privacy, or other rights of any third party, and is not unlawful, defamatory, or offensive.

   You grant us a limited license to use, reproduce, and modify Your Content solely as needed to produce your order and provide proofs. We may decline or cancel any order involving content we reasonably believe is infringing, unlawful, hateful, or otherwise inappropriate. You agree to indemnify and hold us harmless from any claim arising out of Your Content.

   For best results, please follow our artwork guidelines, available on our About page. If a file is not suitable for engraving, we will contact you and may offer to clean up or convert it; a small design fee may apply depending on the work required.

5. Pricing and PaymentAll prices are listed in U.S. dollars (USD) and are exclusive of applicable taxes and shipping unless stated otherwise.

   Payment is processed securely through Stripe. By submitting an order, you authorize us to charge your selected payment method for the total amount, including taxes and shipping.

   Tiered minimum-order-quantity (MOQ) and bulk pricing may apply automatically as quantity increases, as shown at checkout or in a custom quote.

   We strive for accuracy, but pricing or product errors may occur. If we discover an error affecting your order, we may correct it and, where the corrected price is higher, contact you to confirm or cancel before proceeding.

6. Order Acceptance and CancellationYour order is an offer to purchase. We reserve the right to accept or decline any order at our discretion, including where products are unavailable, content is inappropriate, or we suspect fraud. If we decline an order after payment, we will issue a refund. Cancellation requests are only possible before production begins; see our Returns Policy for details.
7. Shipping and DeliveryWe ship within the United States only. Processing times, shipping methods, and estimated delivery windows are described in our Delivery Policy, which forms part of these Terms.
8. Returns and RefundsBecause our products are custom and made to order, all sales are generally final. We do, however, stand behind our work and will resolve workmanship or supplier errors. Full details are set out in our Returns Policy, which forms part of these Terms.
9. Product VariationsOur products are hand-checked and individually engraved. Slight variations in color, finish, grain, placement, and material are inherent to handmade and engraved goods and are not considered defects. Screen settings may also cause on-screen colors to differ slightly from the finished product.
10. Engraved Accessory and Firearm-Related PartsCertain products we offer, such as engraved slide back plates, are decorative aftermarket accessory parts. These items are cosmetic in nature. You are solely responsible for ensuring that your purchase, possession, installation, and use of any such part complies with all applicable federal, state, and local laws and regulations, and that you are of legal age to purchase them. We do not provide legal advice or guidance on firearm assembly, modification, or legality, and you agree to use these products lawfully and at your own risk.
11. Prohibited UsesYou agree not to use the Site or our services to engage in any unlawful activity, infringe the rights of others, transmit harmful or malicious code, attempt to gain unauthorized access to our systems, or interfere with the proper operation of the Site.
12. Our Intellectual PropertyThe Site and its content — including text, graphics, logos, product images, and design — are owned by or licensed to Defiance Laser and are protected by intellectual property laws. You may not copy, reproduce, or use our content without our prior written permission. The Defiance Laser name and logo are our property.
13. Disclaimer of WarrantiesExcept for our commitment to address workmanship and supplier errors as described in our Returns Policy, the Site and products are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
14. Limitation of LiabilityTo the fullest extent permitted by law, Defiance Laser will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site or our products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.
15. IndemnificationYou agree to indemnify, defend, and hold harmless Defiance Laser and its owner from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site or products, or Your Content.
16. Governing LawThese Terms are governed by and construed in accordance with the laws of the State of [State], United States, without regard to its conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in [State].
17. Changes to These TermsWe may update these Terms from time to time. The version posted on the Site at the time you place an order governs that order. When we make changes, we will update the “Last Updated” date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
18. Severability and Entire AgreementIf any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, Returns Policy, and Delivery Policy, make up the entire agreement between you and Defiance Laser regarding the Site and your purchases, and supersede any prior agreements on that subject.
